1. Service Description

Market Canary ("the Service") is a market health monitoring tool operated at marketcanary.co. The Service tracks publicly available market data and provides a composite score based on four quantitative indicators: trend, drawdown, volatility, and credit stress.

The dashboard is freely accessible. Free users receive unlimited weekly reports (Fridays). Daily reports are available as a trial limited to 3 dispatches. Paid subscriptions provide unlimited daily email and push notification alerts based on the market data.

2. Not Financial Advice

The Service is an informational tool only. Nothing provided by Market Canary constitutes financial advice, investment advice, trading advice, or any other form of professional advice. The scores, severity levels, and indicators presented are algorithmic outputs based on publicly available market data and should not be relied upon as the sole basis for any investment decision.

You should always conduct your own research and consult with a qualified financial advisor before making investment decisions. Market Canary is not a registered investment advisor, broker-dealer, or financial planner.

3. Best Effort Service

The Service is provided on a best effort basis. We do not guarantee:

• Continuous, uninterrupted, or error-free operation
• That notifications will be delivered at any specific time or at all
• The accuracy, completeness, or timeliness of market data
• That the Service will be available at all times

Market data is sourced from third-party providers and may be delayed, incomplete, or temporarily unavailable. We are not responsible for errors or omissions in upstream data sources.

4. Accounts and Authentication

Accounts are created using email-based magic link authentication. You are responsible for maintaining access to the email address associated with your account. We do not store passwords.

You may delete your account at any time from the Account tab. Account deletion is permanent and removes all associated data.

5. Subscriptions and Billing

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorise recurring monthly charges to your payment method at the rate displayed at the time of purchase.

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• Daily report trials are limited to 3 dispatches and non-renewable

6. Push Notifications

Push notifications are delivered via ntfy.sh, a third-party open-source service. Market Canary is not responsible for the availability or reliability of ntfy.sh. A unique, non-guessable topic name is generated automatically for each user. Notification topics are not encrypted or access-controlled by default on ntfy.sh.

7. Data and Privacy

We collect and store:

• Your email address (for authentication and email notifications)
• Your ntfy.sh topic name (if configured)
• Your notification preferences
• Subscription and billing status (payment details are held by Stripe, not by us)

We do not sell, share, or provide your personal data to third parties except as required to operate the Service (Stripe for payments, AWS SES for email delivery). We do not use tracking or analytics cookies.

8. Limitation of Liability

To the fullest extent permitted by law, Market Canary and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment losses, arising from your use of or inability to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Acceptable Use

You agree not to:

• Use automated means to scrape or extract data from the Service
• Attempt to interfere with or disrupt the Service
• Create multiple accounts to circumvent trial or subscription limits
• Redistribute notification content commercially

We reserve the right to suspend or terminate accounts that violate these terms.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email to active subscribers. Continued use of the Service after changes constitutes acceptance of the updated terms.
